1. THE SUBJECT OF THE CONTRACT

The Purchaser (s) agrees to buy and Seller agrees to sell the below described kitten pursuant to all of the following terms.

2. RIGHTS AND OBLIGATIONS OF THE SELLER

2.1. To sell the kitten no younger than 16-18 weeks old. The kitten at the time of sale must be: vaccinated according to the age, identified and regularly dewormed

2.2. The Breeder shall warn the Purchaser about the defects of the kitten, if any detected at the time of sale. The Seller and the Club are not responsible for the sale of the kitten, with defects which were not possible to state at the activation time in the club and at the time of sale.

2.3. The Seller guarantees the quality of the kitten, which is specified by this contract at the time of sale and does not guarantee the future show career of the kitten and its reproductive qualities.

2.4. The Seller reserves the right to use any photos of the purchased kitten in any and all advertising, no matter when the pictures were taken and who is the author of the shots, except for pictures that are protected by copyright law.

3. RIGHTS AND OBLIGATIONS OF THE PURCHASER

3.1. During the first year of life, pictures of kitten should be taken and then sent to the Seller at least once per month.

3.2. If the kitten was sold as a PET – The Purchaser agrees that this kitten will be neutered/spayed within 8 months of age and agrees and guarantees that this kitten will not be used as stud or for breeding. If the animal has still been used for breeding, the Purchaser shall pay the Seller a fine which will be three times more than the value of the purchased kitten.

3.4. If the kitten was sold as a BREED or SHOW – it shall participate in exhibitions within 2 years (once - in the kitten class and once - in the junior class and then till obtaining the title of International Champion). The Seller should be informed about the results of the exhibitions.

3.5. Throughout the life of the above mentioned animal in this contract kittens born from Cat ___________ of Happy Song must not be sold for breeding in the Baltic States (Latvia, Lithuania, Estonia), as well as in the cities: _______

3.6. If the Purchaser decides to resell the cat or does not want to have it any more, he/she must inform the Seller about this decision.

3.7. Purchaser agrees to care of this kitten by providing proper love, attention, nutrition, routine veterinary care including vaccinations and immediate veterinary care for kitten showing any sign of illness or distress.

The animal cannot be left without a human care for a long time, cannot be neglected or abused and shall be provided with enough attention and proper care (quality of food, special toys, timely veterinary care, vaccinations, games, limiting free access of the animal to the roadway, security windows and balconies, etc.). The Purchaser also ensures that the kitten will not be abandoned to their fate, thrown into the street, will not be kept in a cage etc. and will not be euthanized without serious medically justified indications.

4. PAYMENTS. TERMS OF PURCHASE/SALE OF KITTEN

4.1. The Full payment for the kitten is considered to be done, if the Purchaser has paid the full amount „____,00” EUR (_____ EUR) and paid the additional costs such as accessories, transportation, etc. - «____» EUR ( _____ EUR), what makes the total amount„______,00” EUR (________EUR).

4.2. Reservation of the kitten: The Purchaser chooses a particular kitten, fills the Agreement or the Purchaser sends the necessary information to the Seller, then transfers prepayment of 30% of the total cost«____,00» EUR. There sometimes might be additional expenses for the kitten, if any they must be paid «_____.00» EUR( _______EUR). The Transfer of the prepayment must be done within 3 days from the date of approval of the contract between the Seller and the Purchaser.

4.3. Buying the kitten: on the advanced appointed day, the Seller will give the kitten and the veterinary certificate to the Purchaser. At the time of giving the kitten, the Purchaser pays the seller the remaining 70% of the cost of the kitten or «_____,00» EUR (_______ EUR).

4.4. In case of sending of the kitten with a third party, or CARGO - 100% prepayment is required.

4.5. If the Purchaser does not fulfill the conditions in paragraphs 4.2. and 4.3. of this contract, the Seller will consider that the Purchaser refuses to buy the kitten. In this case, the Seller offers the kitten to other Purchasers, without refunding the prepayment for preliminary reservation.

4.6. After signing the contract and full payment for the kitten, the kitten belongs to the Purchaser.

4.7. The procedure for obtaining of the document certifying the origin of the kittens (pedigree):

4.7.1. If the kitten is sold as a PET (family pet), then the Seller will send the pedigree of the kitten to the Purchaser by mail after receiving a certificate from a licensed veterinarian about Neutering/Spaying of the animal. The certificate must contain: the date of birth, full name and chip number, there also should be a record about sterilization which was done: the date of operation, name, signature of the doctor and the number of his license. The certificate can be replaced by a note by a licensed veterinarian on the last page of the veterinary passport.

The Purchaser must provide the Seller with an original Neuter/Spay Certificate (naming and describing this kitten) in order to receive the pedigree. Once the Seller receives an original Neuter/Spay Certificate, the Seller will forward the kitten’s pedigree and registration papers marked “Not for Breeding” to the Purchaser.

4.7.2. If the kitten is sold as a BREED (for breeding), the Seller will send the pedigree of the kitten to the Purchaser together with transporting the animal at the same time.

5. RESPONSIBILITIES OF THE PARTIES

5.1. The Purchaser has no right to return the kitten back to the Seller and request to refund the amount already paid, if the seller has fulfilled all the conditions of the Agreement.

5.2. If the kitten gets sick or dies within 5 days from the date of purchase, the Purchaser must obtain the conclusion of a licensed veterinarian. If the veterinary certificate confirms that the kitten was infected before the sale, the Seller shall refund the full amount received in case of death of the kitten, or will cover all expenses for treatment of the kitten in accordance with the payment document. If it was found out, that the kitten became ill or died through the fault of the Purchaser, the money will not be returned.

5.3. If a reserved kitten becomes ill or dies while it is at the cattery, the Seller shall refund the deposits for reservation in full.

5.4. The Seller is not responsible for the kitten, if the Purchaser has decided to entrust its transportation to a third party or to a CARGO company.

7. DURATION OF CONTRACT AND OTHER CONDITIONS

This contract is legally binding to all signing parties. The contract is made in two authentic copies, having the same legal force. One copy of the contract is for the Seller and the other copy for the Purchaser. Both sides agree to all the conditions and terms of the contract and confirm it with their signatures. The contract is made electronically without the original signatures of the Seller and the Purchaser and shall come into force at the time of receiving of the deposit into the Sellers bank account. The bank invoice of the payment is an obligatory part of the contract and is proof of validity of the contract.

8. THE ACT OF DELIVERY OF THE KITTEN

The Purchaser or his/her authorized representative inspected the kitten. The Purchaser has no complaints about the physical appearance and behaviour of the kitten. The Payment is made fully.
